Sikora v. Sikora

2009 B.C.S.C. 195

Facts
The testator died December 20, 2004 and had 4 sons, one by his first wife and three by a common law relationship.  He married in 1986 Ms. Sikora, his third spouse.

He left:

a) $500. To first son;
b) The home, furnishings and auto to Ms. Sikora; and
c) $11,569. Net residue to three other sons.
Ms. Sikora owned rental properties and had a net worth or $1.1 M.

Held
The Testator and Ms Sikora had kept heir assets somewhat separate, she was well managed.  The Testators estate had consolidated in a way that benefitted Ms. Sikova.  The son’s were given tenancy in common of the matrimonial home subject to a life tenancy.  The testator was a harsh parent.
