- The Executor is to be neutral with respect to a wills variation claim.
- An executor should file a response stating that they intend to be neutral and they are available to assist the court with respect to information about the estate.
- An executor is often a beneficiary, so on a wills variation claim, he/she would be identified as a defendant in his/her capacity as executor, and also in his/her personal capacity as a beneficiary. In their personal capacity, they do not need to be neutral.
