- Not getting on with administering the estate
- Denying assets are assets of the estate
- Are not getting on with applying for probate
- Executor is administrator is a trustee and must act in best interests of parties
- Various mechanisms can be used eg. file a notice of dispute or file a citation,
- Court has a supervisory role at all times
- Person can apply to have them removed
David Hobbs explains notices of dispute and citations:
- Filing a notice of dispute is communicated to all probate registries in BC, and registry will interrupt process
- Normally leads to a hearing in court
- Stalls the application process until it is looked at more closely
