David Hobbs of Hobbs Giroday successfully represented an executor named in a will in removing a certificate of pending litigation that was disrupting the completion of a real estate transaction that had been agreed to before the will maker died but, was completing after her death.
The Court order also authorized the executor, notwithstanding the probate was contested, to pay taxes outstanding and to attend to certain matters of business involving the estate on a limited agency basis.
The executor, although not formally appointed yet, was held to have status by the Court to obtain the relief sought.
